The Supreme Court is on the verge of restricting the Environmental Protection Ag

The Supreme Court is on the verge of restricting the Environmental Protection Agency’s ability to limit carbon dioxide emissions from power plants.⁠

The court’s conservative majority appears likely to side with Republican-controlled states and coal companies in West Virginia v. EPA, for which the court heard oral arguments on Feb. 28 and is expected to issue a ruling in June. Such a ruling could eliminate some of the key methods that the Biden administration can use to accelerate the power sector’s transition to cleaner sources of energy, potentially hamstringing its ability to meet the president’s goal of halving greenhouse gas emissions by 2030.⁠

Experts say that the court is virtually guaranteed to side with the petitioners — a coalition of red states and coal companies — but that the still unknown logic and details of the ruling may determine the shape of U.S. climate regulation in the future.⁠

“Taking the case is a very clear sign that they’re going to rule against EPA in some way, but we don’t know how,’ David Doniger, senior strategic director of the Climate & Clean Energy Program at the Natural Resources Defense Council, told Yahoo News. “It wasn’t clear from the oral argument what the dominant approach would be.”⁠

Observers do not expect the Supreme Court to overturn previous rulings that give the EPA authority to regulate carbon pollution, but they say it’s possible the court may say the agency cannot use certain tools in doing so.⁠

Big Rigs, those w/ 6 cylinders & a turbo that currently are powered by ULSD R only 5% of the trucks on the road in the U.S. However they generate almost 25% of all GHG emissions from the transportation sector. These vehicles cause the most majority of lung damaging air pollutants including NOx & particulate pollution. Both posing serious public health risk 2 us all & damage 2 the climate of planet Earth. Diesel emissions increase the risk of cancer & can lead 2 premature death, hospitalizations, & ER visits 4 exacerbated chronic health & lung disease including asthma increased respiratory symptoms & decreased lung function. These harmful impacts from heavy duty vehicles fall disproportionately on communities of color that R often located near heavy duty traffic & trucking corridors. 1 is currently planned on 96th & Keystone n Indianapolis, IN approximately 500 ft from Carmel Indiana & less than a ¼ mile from a currently slated high density urban living project N Fishers, IN next 2 a tributory of the White River which is a known health hazard as is. Therefore as a consumer I care about this issue because heavy duty trucks like these deliver the everyday goods I rely on 4 the end of mile journey that I transport in a vehicle that exceeds those of Cafe Standards by my own tuning. Thus consumer goods should B delivered on trucks that do not have negative impacts on communities living near trucking routes. Smog & Soot pollution caused by trucks & buses R among the greatest threats 2 public health 4 the more than 45 million people N the US living w/n 300 ft of a major roadway or transportation facility. The US has the technology & ability 2 cut pollution & save money today. Cleaner trucks R not only available & ready now. They R also projected 2 B cheaper 2 own & operate than their combustion engine counterparts w/n 5 years. There R dozens of zero emission medium & heavy duty truck models already available or coming 2 the market w/n 5 years. The International Community is doing far better 2 preserve a Globally Sustainable Future.
