Kochi: The Kerala High Court on Friday ruled that early bail in Unlawful Activities (Prevention) Act (UAPA) cases would not be valid except in extraordinary circumstances.

The court remark came in response to an early bail request filed by Pothiyil Ahmed Kutty, a native of Perinthalmanna and a defendant in the 2020 Kerala gold smuggling case. Ahmed Kuti, who traveled overseas after the case, has yet to be apprehended by the National Investigation Agency (NIA). He moved to the High Court after a special NIA tribunal rejected his bail application.

The bench of Judges PB Suresh Kumar and CS Sudha ruled that the defendant committed the act knowing that it would jeopardize the financial security of the country. Meanwhile, the court took into account that the Supreme Court has yet to rule on an appeal by the NIA against the High Court’s prior observation that imposing the UAPA against the defendant in the case was wrong.

The court accepted the NIA’s argument that the accused should be taken into custody for questioning in the case.
